Kevin Simpkins, the Firefighter who was suspended for driving an FDNY vehicle after he’d tested positive for marijuana use, has been allowed to retire with a disability pension rather than being fired for the offense.
An Administrative Law Judge in December recommended his termination, which would have precluded him from collecting the disability benefit, worth three-quarters of his final average salary tax-free. Mr. Simpkins filed for disability after an accident in which he was T-boned in January 2014 while driving the FDNY vehicle, causing a shoulder injury that required surgery and still limits his work options.
